1. Acceptance of Terms

By accessing or using the Optigrants platform and services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.

2. Services

Optigrants provides grant discovery, eligibility assessment, application support, and related consulting services. Our services are advisory in nature. We do not guarantee funding outcomes. Grant approval decisions rest solely with the relevant funding bodies.

3. No Guarantee of Results

Optigrants makes no representation or warranty that any grant application will be successful. Past results described in case studies or marketing materials are not guarantees of future outcomes.

4. Client Responsibilities

You are responsible for:

• Providing accurate and complete information
• Reviewing all application materials before submission
• Complying with all grant program requirements and reporting obligations
• Maintaining the confidentiality of your account credentials

5. Fees & Payment

Fees are as described in your service agreement or on our Pricing page. All fees are in Canadian dollars and are exclusive of applicable taxes. Fees are non-refundable once work has commenced, unless otherwise agreed in writing.

6. Intellectual Property

Application materials prepared by Optigrants on your behalf become your property upon full payment. Our platform, tools, and methodologies remain the intellectual property of Optigrants Inc.

7. Limitation of Liability

To the maximum extent permitted by law, Optigrants shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

8. Not Legal or Financial Advice

Our services do not constitute legal, accounting, or financial advice. We recommend consulting qualified professionals for complex eligibility, tax, or legal questions.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

11. Data Processing and AI Consent

By using Optigrants, you acknowledge and agree that we may use Artificial Intelligence (AI) and Machine Learning (ML) technologies to process your data, including but not limited to your organization's profile, activities, and uploaded documents. This processing is performed for the purpose of matching you with relevant grant opportunities, analyzing eligibility, and improving our services. You retain ownership of your data, and we do not share your sensitive data with third parties for their independent use without your explicit consent.
